PROTECTIVE ORDER
In November of 2017, Dawn and Rod were served with Petitions for Orders of Protection by the King County Sheriff’s Office, based on Dr. David-Paul Zimmerman ("DPZ") calling the police with outrageously false claims that they had acted in a threatening manner toward him.
On the evening of November 17, 2017, Randi accompanied D.K. to Amazing Grace, located 4 houses from the Fernandez residence, to pick up D.K.'s Microsoft Surface, which was being held at Renton Prep. Given that it was dark outside, Dawn, Jasmine, and Hailey decided to drive the short distance to the AGCS campus to pick up the two girls. While en route, Dawn received a call from Randi and was informed that Renton Prep would recycle D.K.'s laptop if she failed to pick it up.
As Dawn pulled up to the street next to AGCS, she saw DPZ walking toward his vehicle parked a couple cars in front of her. Dawn and her daughters hoped to get his attention before he could leave the campus, thus making him aware that D.K. still needed two of her belongings. Ultimately, DPZ drove away without acknowledging the Fernandezes, so Dawn circled the block to return back and pick up Randi and D.K. As she approached AGCS, Dawn saw Rod in his stopped vehicle with his van window rolled down, speaking with the girls and asking them where Dawn was. Once Rod saw Dawn's vehicle approaching behind him, he knew that the two girls were being picked up and resumed driving to work, as he works swing-shift.
Dawn was only attempting to assist D.K. and her mother in obtaining the Surface pen and case, so that they wouldn’t be recycled.
[Note: DPZ is in possession of the subject video clips of Dawn's and Rod's vehicles driving up the street, which contradicts his grossly fabricated narrative. If you wish to see for yourself, please ask and see if DPZ will allow you to view the two recordings. You be the judge.]
DPZ's initial attempt to obtain a temporary Anti-Harassment Order against Dawn and Rod was denied
King County District Court Judge Laurel Gibson cited that DPZ "failed to demonstrate that there is sufficient basis to enter a temporary order without notice to the opposing party [Fernandezes]."
DPZ went on to file Petitions for Orders of Protection against both Dawn and Rod, where he falsely stated that he's "a victim of stalking...and unlawful harassment."
Throughout his petitions, DPZ cited multiple false and outrageous allegations, and included a copy of his September 28, 2017, Declaration in Support of the Motion for Summary Judgment.
Subsequently and notably, the Defendants’ motion for summary judgment was denied by King County Superior Court Judge David Keenan.
In his statement describing his need for protection from Dawn and Rod, the following are just some of the many ludicrous allegations by DPZ:
1) "On November 17, 2017, harassment from Randi Fernandez [then 13 y/o], trespassing on school property entering the building while children were still present, compromising the safety policy of the school..." [See Petition, p. 4 of 12]
2) "I was afraid of [Dawn] crashing into me as she drove on the wrong side of street," and "My heart started pounding and I was shaking as I tried to drive away as quickly as possible...to avoid what looked like an imminent car crash into me by Dawn Fernandez." [See Petition, p. 5 of 12] [Note: Two of Dawn's children were in the vehicle with her: Jasmine was in the front passenger seat, and Hailey was in the back passenger seat, and both had their windows rolled down. DPZ was parked on the right side of the street.]
3) [Later that night when DPZ was in bed asleep, he writes] "My daughter [Michelle] told me that the house phone rang multiple times when I was asleep, listed as unknown private caller but no one spoke on the other end of the line when she said hello." [See Petition, p. 6 of 12]
4) "Sometime after May 24, 2016 and before June 2016: Kenny Rogers (father of Eidrea Akamine-Rogers) warned me that Dawn Fernandez and Dede Akamine, were planning to ruin my daughter's and wife's reputations. He thought they'd cool down in a week or two...He identified that this incident was incited by middle school jealousy." [Note: Kenny Rogers vehemently denies that he ever had this conversation with DPZ.] [See Petition, p. 7 of 12]
5) "The Fernandez family knows where my family lives and has been in our driveway." [See Petition, p. 9 of 12]
6) "Fernandez family encouraging continued gossip spread about the bullied girl, claiming it was the bullied girl's fault the Fernandez family was disenrolled, leading to further isolation of the bullied girl during 2016-2017 school year..." [See Petition, p. 8 of 12]
7) "Fernandez got family and friends involved with cyber stalking..." [See Petition, p. 8 of 12]
8) "On September 16, 2017: A friend of the Fernandez family: Dede Akamine, stalked my daughter, Dr. Michelle Zimmerman, at Renton City Comicon where my daughter was presenting the next day with two students from the school..." [See Petition, p. 9 of 12]
[On a side note: It's actually quite amusing how the Zimmermans, throughout the lawsuit, referred to Dawn/Randi and Dede/Eidrea as people who called themselves cousins, but were really just close family friends. Dawn and Dede are, in fact, biological (1st) cousins; thereby making Randi and Eidrea biological (2nd) cousins.]
9) "October 28, 2017, early afternoon: Mr. Fernandez [Rod] passed me in the car when I was leaving work and appeared to give me a threatening hand gesture that made my heart pound and caused a fear response." [See Petition, p. 9 of 12]
Rod, Dawn, their children, and all the people DPZ falsely accuses in his Petitions for Orders of Protection, were fully prepared to present evidence and ardently refute DPZ's hyperbolic and unbelievably over-the-top accusations, at the hearing set for December 20, 2017. However,
DPZ dropped the harassment petition five days before the hearing date.
There was never any harassing or threatening behavior towards DPZ by either Dawn or Rod.
The Zimmermans went to extreme measures in an attempt to bring the Fernandez family down.
In fact, during the litigation process, they alluded that a possible civil lawsuit against the Fernandez family was under serious consideration based on three police officers’ view that DPZ should take this physical threat as serious.
According to DPZ’s petition for an order for protection, he wrote:
"Based on the November 17, 2017 incident with a vehicle, and the upcoming court hearing, the Police Officer identified real threat for personal safety of myself, my family, and school violence potential, as physical threat of violence already occurred on the school campus on May 20, 2016."
Police officers are trained to investigate all sides of a situation that is presented to them. It is not surprising that the police would have advised DPZ of his option to file a no contact order, especially if DPZ claimed to have felt threatened. Once again, DPZ is attempting to create a false narrative in order to influence the judge's perception of guilt.
All DPZ’s allegations are false.
